The Health Insurance Portability and Accountability Act (HIPAA) was enacted by the U.S. Congress in 1996. According to the Centers for Medicare and Medicaid Services (CMS) website, Title I of HIPAA protects health insurance coverage for workers and their families when they change or lose their jobs. Title II of HIPAA, known as the Administrative Simplification (AS) provisions, requires the establishment of national standards for electronic health care transactions and national identifiers for providers, health insurance plans, and employers. It helps people keep their information private.

The Administration Simplification provisions also address the security and privacy of health data. The standards are meant to improve the efficiency and effectiveness of the nation's health care system by encouraging the widespread use of electronic data interchange in the U.S. health care system.

Oxygen Solutions, LLC is dedicated to protecting your medical information. We will use your medical information in supporting your healthcare products and all your needs. Your medical information will be used by Oxygen Solutions, LLC personnel as it relates to our products and services. It will also be used by your treating physician as it related to products and services prescribed for you. Your medical information may also be used to contact you to provide information about other health-related benefits and services that may be of interest to you.


OTHER USES AND DISCLOSURES OF PROTECTED HEALTH INFORMATION

Personal Representatives

If you have given power of attorney to a friend or family member in regards to your healthcare, we may disclose your Protected Health Information to that individual.


Required by Law

Oxygen Solutions LLC may use or disclose your Protected Health Information when required by federal, state or local law. The use or disclosure will be made in compliance with the law and will be limited to the relevant requirements of the law. For example, the office of Civil Rights or the Office of the Inspector General may require access to your protected health information while conducting audits or investigations of reported privacy breaches or violations. By law, we must make disclosures to you and when required by the Secretary of the Department of Health and Human Services to investigate or determine our compliance with the requirements of the Health Insurance Portability and Accountability Act of 1996.


Legal Proceedings

In the course of certain judicial or administrative proceedings, Oxygen Solutions, LLC may disclose your Protected Health Information.


Coroners, Funeral Directors, Organ Donors, and Medical Examiners

Oxygen Solutions, LLC may disclose Protected Health Information to coroners, medical examiners, funeral directors, or organ donors for identification purposes, determining cause of death, or to perform duties authorized by law.


Workers Compensation

Oxygen Solutions ,LLC may disclose your Protected Health Information in order to comply with workers compensation laws as they apply.


Military Personnel

Oxygen Solutions, LLC may disclose your Protected Health Information to military authorities, and as applicable, foreign military authorities.


Inmates

If you are an inmate of a correctional facility, or under the custody of a law enforcement official, Oxygen Solutions, LLC may disclose your Protected Health Information to the correctional facility or law enforcement official for the health and safety of the inmate and others.

Change of Ownership

In the event that Oxygen Solutions, LLC is sold or merged with another organization, your Protected Health Information will become the property of the new owner.


Your Rights Regarding your Protected Health Information

You have the right to inspect and copy your Protected Health Information. You have the right to request restrictions or limitations on certain uses and disclosures of your Protected Health Information. You have the right to receive information from us in a confidential and private manner.

You have the right to file a complaint to Oxygen Solutions, LLC or to the United States Department of Health and Human Services if you believe that we have violated your privacy rights. You will never be penalized for filing a complaint. Oxygen Solutions LLC, will never retaliate against anyone who files a complaint.
